Why should I defend the foreclosure if I realize I am behind on payments?

You should defend a foreclosure or at least have a lawyer that specializes in foreclosures. Look at your case because a lot of times the banks have sold the paper, in other words sold your note mortgage to other banks. After three or four times, sometimes banks actually lose the paperwork.

We’ve been able to keep some folks in their home even after two or three years after a foreclosure case was filed because the banks switched law firms, they can’t find the paperwork, the case gets dismissed. If you want to stay in your home for free, if the bank has messed up or lost the paperwork, you should at least have your case reviewed by a foreclosure attorney.
