In a Florida wrongful death case, the claim must be brought by the estate of the deceased person. What that means is that an estate has to be opened in a court where someone is appointed as what we call the personal representatives – in some states, they’re called the executor. That person brings the claim on behalf of all of the beneficiaries of the person who is killed. Those beneficiaries could include husband, wife, children, or adopted children.
