Is the owner of a Florida business or other premises legally responsible for injuries sustained in a trip and fall accident?

Many people assume that because a person owns a store or a business, that they are responsible, that the owner is responsible for anything that happens in that store. That’s not the case. A store owner or a business owner has a duty to maintain the premises in a reasonably safe condition. That’s not a perfect condition. We don’t live in a perfect world. By the same token, the person entering the store has a duty to watch where he or she is going and not to fall over things that are right in front of them.

Unless the business owner is negligent or careless in failing to maintain the property in a reasonably safe condition, they’re probably not going to be responsible for somebody tripping over their own two feet or something that’s open and obvious right in front of them.
