If you’ve been involved in a car accident and someone else was at fault, you can sue them, even if you were not wearing your seatbelt at the time. Florida is a comparative-fault state, meaning that to the extent that you caused your own injuries, in part or in whole, because you weren’t wearing a seatbelt, your fault will be assessed against you. However, the fault of the driver of the car that caused the accident will always be assessed against them, so you still have a claim, even if you didn’t wear your seatbelt.
