In Florida, before your case is filed as a lawsuit, it’s typically common to try to resolve the case with the insurance company. This can be done through simply making a claim and trying to negotiate over the phone or through letters. If that doesn’t work many times there is a pre-suit mediation process by which you can all meet together with a mediator, third party neutral and try to resolve the case.

If that doesn’t work and you actually do file a lawsuit, those same alternative dispute resolution options are still available, which means that mediation will be available and you can try to settle your case that way.
