Do I have to get out of the property 20 days after the summons is received?

Return to FAQ Videos

In a foreclosure case, you do not have to leave your property until after the foreclosure sale, when the bank or any other purchaser of the foreclosure sale is issued what is known as a certificate of title. Generally, that occurs 10 days after the sale itself. If you get served with a foreclosure lawsuit and the sale doesn’t happen until a year later, you can remain in your home for the entire time until the certificate of title passes to the new owner.
